PROCEEDINGS:-

            In the reference first cited, orders were issued regarding staff norms in the four Thermal Power Stations based on a review made by a High Level Committee constituted for the purpose.   In view of the order of stay obtained in W.P. No.14877 of 2000, the above said order could not be implemented to the employees of Class-III and IV service working in all the four Thermal Power Stations.  The above case ended in favour of the Board.  The Writ appeal in W.A.No.1671 of 2009 filed as against the orders in W.P.No.14877 of 2000 was also disposed of. 

         2)  Based on the clause made in the Wage Revision Settlement dated:18-11-2009, a Committee was Constituted to study the issue of promotional avenues of Regular Work Establishment employees working in all the four Thermal Power Stations.  The said Committee’s report was examined by the Wage Revision Committee and based on the above, the recommendations made by the Wage Revision Committee was given to the Unions by way of a 9-A Notice and the views of the Unions obtained.  The views expressed by various unions have been carefully considered and the matter was placed before the Board in its meeting held on 17-9-2011 and the full Board has approved the proposal.  Instead of a Settlement under Section 12(3) of the Industrial Disputes Act 1947, the Unions have demanded a Settlement under Section 18(1) of the Industrial Disputes Act 1947 and the same was accepted.

        3)   During the Settlement, based on the demand made by most of the Unions, the words in para-vi of the Terms of Settlement  “as one time measure” and in para-xiii,  “with the approval of the Board” were deleted.  Accordingly, a Settlement under Section 18(1) of the Industrial Disputes Act was entered into on 26-3-2012 with the following Unions which are being invited for discussions at Apex Level:-

Tamil Nadu National Electricity Workers’ Federation (Xavier Group).

Tamil Nadu National Electricity Workers’ Federation (Swarnaraj Group).

9)
Tamil Nadu Electricity Board Engineers' Sangam.

10)
Tamil Nadu Electricity Employees Congress.

:: 3 ::

          4)  Consequent on the above Settlement, the following orders are issued which will take effect from the date of Settlement:-

        i.            The existing staff strength in all the Four Thermal Power Stations shall be revised  as in Annexure –I of this order, which includes the available strength of Technical Assistants/ Tester Chemical under state seniority.  For the purpose of promotion of Regular Work Establishment employees other than Technical Assistants/Tester Chemical, the total strength in the respective Pay band category shall exclude the existing strength of Technical Assistant/Tester Chemical. 

      ii.            The present Station-wise seniority shall be maintained.   


    iii.            Due care shall be taken in posting the women employees to the areas like Coal Handling Plant and Ash Handling etc.,  The present women employees shall be allowed to take transfer to nearby Electricity Distribution Circles in the same category, if they prefer to do so.

    iv.            The existing procedure for transfer to nearby Electricity Distribution Circle’s shall be continued to be followed in the case of transfer from Thermal Power Stations.

     v.            The employees shall work in a post for atleast six months before getting a promotion to the higher post to avoid double promotion within a short period.   


    vi.            Relaxation of Educational qualification is permitted to the Regular Work Establishment employees covered in this Settlement in all the four Thermal Power Stations  as a special case.

  vii.            388 Lineman equivalent posts shall be abolished and  388 Line Inspector equivalent posts shall be created in Thermal Power Stations on par with Distribution Circles.


viii.            Pay Band wise, sanction of posts is accorded to each Thermal Power Station  and the respective Chief Engineers of the Thermal Power Stations have empowered to re-distribute the total strength based on the need in each Divisions.

    ix.            Consequent on the revised staff pattern, there shall be no reversion or retrenchment.    The employees on promotion shall be retained in the same Thermal Power Station in the new posts.  The surplus staff shall be re-deployed in the nearby ongoing Thermal Projects on Commissioning.  If there is still surplus they shall be transferred to nearby Distribution Circles.                            Re-deployment of surplus staff will be discussed with Unions and decided separately for effective utilisation of the Surplus Man Power.

      x.            1302 posts are created and 1083 posts are abolished in Regular Work Establishment cadre in all four Thermal Power Stations in available posts.  The details of creation and abolition of posts are in Annexure-II.

    xi.            The staff strength now sanctioned to  Mettur Thermal Power Station in Annexure-I shall be utilized for the existing Mettur Thermal Power Station (4x210 MW) and to the Mettur Thermal Power Project 600 MW Unit on its commissioning.


  xii.            The  staff strength  now sanctioned to North Chennai Thermal Power Station and Ennore Thermal Power Station as in Annexure-I shall be utilised  to the existing North Chennai Thermal Power Station (3x210 MW), Ennore Thermal Power Station and for North Chennai Thermal Power Extension Project  (2x600 MW) duly considering the  de-commissioning of Ennore Thermal Power Station.

xiii.            Upgradation of the Selection Grade  Helpers  as Supernumerary Fitter Gr.II will be considered.

xiv.            In view of the above settlement, the Unions are agreed to withdraw the Industrial Disputes, cases, if any pending before any Conciliation Officer/Labour Court/ Industrial Tribunal and other Courts.


         5)  The receipt of the Board’s Proceedings shall be acknowledged.
