PROCEEDINGS:
1. The Board has constitute a committee to examine the cases of Contract Labourers not covered by 12 (3) settlement dated 10.08.2007 under I.D. Act 1947 vide B.P. under reference first cited.
2. Accordingly a proposal has been placed before the committee to examine 282 Contract Labourers in respect of 15 circles who are engaged in RCC/PSC yard, Stores, Civil Wings as similar Contract Labourers engaged in the
other circles are already covered under 12 (3) settlement and absorbed as TCL/CL's. The Committee has suggested that the 282 Contract Labourers covered in respect of 15 Circles may be considered for absorption as TCL/CL's based on their date of engagement as Contract Labourers. The Chairman has also approved the proposal for absorption the said Contract Labourers as TCL/CL's as per the suggestion of the committee. Accordingly, they were

appointed as Temporary Casual Labourer/Contract Labourer vide reference (2) to 12 cited above during the year 2008. Further, the Board has been paid ex-gratia payment to the above Temporary Casual Labourer/Contract Labourers as ordered in the B.Ps' vide reference 13 to 15 read above. Out of 282 Contract Labourers, 50 Contract Labourers have not joined duty for various reasons and the orders are cancelled. Now, there are only 232 Contract Labourers to be engaged among 13 circles mentioned in the annexure continuously.

The Board has considered sympathetically and has decided to absorb the 232 Temporary Casual Labourer/Contract Labourers as Mazdoor, Assessor Grade II, Helper-cum-Meter Reader according to their Educational Qualification on par with 12 (3) settlement without predudice to the pendency of various W.P.'s/W.A.'s pending in the High Court , the I.D.No. 106 pending before the Industrial Tribunal Chennai. Accordingly, the TANGEDCO hereby passes the following orders.
4. The 232 Contract Labourers who submitted the identification format during the year 2008 with photo shall be absorbed into Board's service immediately in the following manner.
a) The Contract Labourers with S.S.L.C. and higher academic qualification shall be appointed as Assessor Grade II in the time scale of pay of Rs. 5400-20200 +1900 G.P. who will do the Meter Reading and Assessment works for full month.
b) The Contract Labourers with ITI qualification in the Trade specified in the Service Regulation of the Board and those with Diploma Qualification shall be appointed as Helper-cum-Meter Reader in the time scale of pay of Helpers. They will do the field work and also according to need, the Meter Reading and Assessment work.
c) The Contract Labourers with other qualification and nil qualification shall be appointed as Mazdoors in the time scale of pay of Rs. 4900-10000+1400 G.P.
d) 204 Mazdoor post shall be created for the absorption of Contract Labourers.
5. The TANGEDCO further direct that the absorption of Contract Labourers ordered above is subject to the following conditions as per the settlement dated 10.08.2007.

a) The Contract Labourers who do not satisfy the general conditions for appointment prescribed in the Regulation 91 (2) will not be considered for absorption.
b) All the 232 Contract Labourers shall not make any claim including EPF with retrospective effect by virtue of their engagement as Contract Labourer in the post.
c) The Contract Labourers absorbed by these proceedings shall already be covered under Contributory Pension Scheme.
6. The Superintending Engineers are informed that the allotment orders in respect of 232 Contract Labourers furnished in the annexure of these proceedings will be issued separately.
7. These orders are issued without prejudice to the outcome of various W.P.'s /W.A.'s filed by the Board against the order of IOL pending before the High Court.
8. Receipt of this B.P. shall be acknowledged.
