PROCEEDINGS :

(1) Based on the 12(3) settlement dt.10.08.07
signed before the Commissioner of Labour, the TNEB issued orders for revival of
the post of Mazdoor and for absorption of contract labourers who have worked
continuously in Distribution Circles, General Construction Circles and Wind
Energy Development Circles as Mazdoor, Helper cum Meter Reader and Assessor
Grade - II in a phased manner vide B.P. (3) read above. As per these orders, the contract labourers
whose qualification is below 10th standard and 'nil' qualification
have been appointed to the post of Mazdoor vide B.P. (3) read above.
(2) Further, based on the various demands from
the unions, TANGEDCO considered the promotion of the Mazdoors in its 22nd
Board meeting held on 06.03.12 and approved the proposal for the relaxation of
rules relating to qualification of NTC/ NAC for promotion to the post of Helper
in a phased manner and accordingly 6,593 Mazdoors were promoted as Helper
(Field Assistant) in the first phase who were working in Distribution Circles,
General Construction Circles and Wind Energy Development Circles were issued
orders vide TANGEDCO Proceedings (7) read above.
(3) In the B.P (1) read above, it had been
ordered that the 73 Contract Labourers working at PUSHEP would be absorbed as
Mazdoor Grade-II (Trainee) on consolidate payment of Rs.2500/- for a period of
two years and on successful completion of two years, they were appointed as Mazdoor,
Helper and Assessor Grade-II based on their academic qualification vide B.P.

(4) Now, various unions in the TANGEDCO have represented
to consider the promotion of the remaining Mazdoors appointed as per 12(3)
settlement and as well as in PUSHEP. The
representations of the Unions have been carefully examined by the TANGEDCO.
(5) Accordingly, the TANGEDCO hereby directs
that the 4660 Mazdoors [4620 (EDC) + 40 (PUSHEP Circle)] who were absorbed
during the period from 28.02.2008 to 30.05.2009 as mentioned in the Annexure
shall be promoted as Helper (Field Assistant) in the time scale of pay of
Rs.5,400 - 20,200 + 1,900 G.P., if they
are or otherwise suitable, subject to the outcome of the Writ
Petition No. 13015 of 2013 pending before the Hon’ble High Court of Madras.
(6) The TANGEDCO also have decided that
consequent on promotion of the 4660 Mazdoors [4620 (EDC) + 40 (PUSHEP Circle)]
who were absorbed during the period from 28.02.2008 to 30.05.2009 the post of 4660
Mazdoors shall be abolished.
(7) The Superintending Engineers are informed
that the total number of Mazdoors appointed during the period from 28.02.2008
to 30.05.2009 are furnished in the Annexure enclosed.
(8) The Superintending Engineers are further
informed to adhere to the following points while issuing orders to the above
Mazdoors as Helpers :

(a)

The Mazdoors
who are to be promoted as Helpers (if they are eligible) may be permitted to relinquish
their rights for promotion (Temporary or Permanent) and continue in service
as Mazdoors till their age of 60 years.

(b)
|
The Mazdoors who
are covered under the above orders and has completed 58 years of age need not
be promoted as Helper rather they should continue as Mazdoor upto the age of
60 years.

(c)
|
That no
reversion is to be accepted to the old post of Mazdoor from the already
promoted Helper post.
|
(9) The receipt of this B.P. should be acknowledged.

The Superintending Engineers
are requested to issue promotion and posting orders to the 4660 Mazdoors [4620
(EDC) + 40 (PUSHEP Circle)] appointed during the period from 28.02.2008 to

Any discrepancies regarding identity, eligibility and Disciplinary
Proceedings against the above Mazdoors may be got clarified from this office
before issuing the order to the concerned individual.
